Activity Waiver & Release
Island Time Axe Throwing of 225 Terminal Ave, Nanaimo, BC V9R 5C7, Canada
IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:
Consideration
a) Being of lawful age and in consideration of being permitted to participate in the activity described below, the Participant releases and forever discharges Island Time Axe Throwing, its owners, directors, officers, employees, agents, assigns, legal representatives and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the activity described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of Island Time Axe Throwing.
b) The Participant understands that the Participant would not be permitted to participate in the activity described below unless the Participant signed this Agreement.
c) Anyone under the age of 15 require a parental or guardian signature.
Details of Activity
a) The Participant will participate in the following activity: Axe & Knife Throwing at Island Time Axe Throwing.
Concurrent Release
a) The Participant acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives and assigns.
Fitness to Participate
a) I am familiar with the risk of serious injury and death which any participant in this activity must assume, and
b) I believe that I am physically, emotionally and mentally able to participate in this activity, and that my equipment is mechanically fit for my use in this activity, and
c) I understand that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with me, and
d) I will immediately remove myself from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness for continued participation in the activity.
e) I am 10 years of age or older to participate. Another ages 10-15 will be accompanied by an adult.
Photography
a) In the event that Island Time Axe Throwing takes photographs or videos, I hereby assign full copyright of these photographs and videos to Island Time Axe Throwing. (and the related representatives and assigns) together with the right of reproduction either wholly or in part. Furthermore, I grant Island Time Axe Throwing the perpetual and irrevocable and unrestricted right to use and publish video and/or photographs of me, or where I may be included for editorial trade, product or service advertising and such other fashion /business purpose in any manner and medium, including advertising with any retouching or alteration without restriction or compensation.
Full and Final Settlement
a) The Participant hereby acknowledges and agrees that the Participant has carefully read this Agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.
b) The Participant understands that by signing this Agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against Island Time Axe Throwing for any property loss or personal injury that the Participant may sustain while participating in or preparing for the above noted activity.
c) The Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Agreement.
d) This Agreement contains the entire agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.
Governing Law
a) This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia.
